Acceptable use Policy (AUP)

This Acceptable Use Policy (“AUP”) governs your use of the Services and is incorporated by reference into GOZFLY’s Terms of Service. Unless otherwise stated, defined terms in this AUP have the same meaning as provided in the Terms of Service. GOZFLY may modify this AUP at any time without prior notice.

By using GOZFLY’s services, you agree to comply with this AUP and all applicable laws and regulations. GOZFLY reserves the right to refuse service to anyone at our sole discretion. Any activity that violates this AUP may result in suspension or termination of your Services, with or without notice, and removal of any associated content.

Failure to respond to communications from GOZFLY’s Abuse Department within the specified time frame may result in the suspension or termination of your Services.

1. Lawful Use of Services

You may only use GOZFLY’s Services for lawful purposes. You agree to comply with all applicable local, national, and international laws. GOZFLY may suspend or terminate Services if we determine, at our sole discretion, that your activity is unlawful, harmful, or exposes GOZFLY to liability.

2. Prohibited Uses

You may not use GOZFLY’s Services, directly or indirectly, for any of the following purposes. These examples are illustrative and not exhaustive.

2.1 Illegal, Harmful, or Abusive Content

Prohibited content includes, but is not limited to:

• Disclosing or storing sensitive personal information about others without authorization.
• Storing or processing protected health information (PHI) or other regulated data without compliance.
• Phishing, impersonation, or identity theft.
• Distributing viruses, malware, worms, trojans, ransomware, or malicious code.
• Promoting prostitution, exploitation, or human trafficking.
• Hosting Ponzi schemes, pyramid schemes, deceptive or unlawful marketing.
• Hosting, distributing, or linking to Child Sexual Abuse Material (CSAM) or content harmful to minors. Accounts containing CSAM are terminated immediately without notice and reported to law enforcement.
• Engaging in the unlawful distribution or sale of controlled substances or prescription drugs, including promotion or sale of medications without a valid prescription.
• Facilitating or promoting violence, terrorism, or extremist activities.
• Infringing copyrights, trademarks, trade secrets or any proprietary rights.

3. Excessive Use of Resources or Network Abuse

You may not consume excessive server or network resources or use GOZFLY’s Services in ways that negatively affect other customers. Prohibited activities include, but are not limited to:

• Hosting or linking to anonymous proxy servers.
• Operating file sharing, warez, or download distribution sites.
• Running scripts, bots, or background processes that adversely impact server stability.
• Hosting software that connects to IRC networks.
• Running high-CPU or high-I/O tasks continuously.
• Using shared hosting accounts for data warehousing or large backup repositories.

GOZFLY reserves the sole right to determine what constitutes excessive usage.

4. Resource Usage in Shared Hosting

Shared Hosting requires balanced resource usage to maintain fair performance for all customers. The following behaviors are not allowed:

• Sustained high CPU, RAM, disk I/O, or process usage.
• Hosting applications requiring heavy computation or intensive database processing.
• Storing massive quantities of data unrelated to website operations.
• Using the hosting account as cloud storage or backup storage.
• Excessive inode usage.
• Running streaming, proxy, VPN, or tunneling services.

If excessive usage is detected:

1. The customer receives a written notification.
2. A minimum of 15 days is given to correct usage.
3. If legitimate usage remains high, GOZFLY may recommend migration to VPS or Dedicated hosting as a more appropriate environment.
4. GOZFLY may throttle, restrict, or suspend the account until the issue is resolved if no action is taken or if instability persists.

5. Unauthorized System Access

You may not use GOZFLY’s Services to gain unauthorized access to any system. This includes:

• Accessing networks or systems without permission.
• Scanning, probing, or testing for vulnerabilities.
• Launching DDoS or DoS attacks or participating in botnets.
• Intercepting traffic or monitoring data without authorization.
• Using automated tools such as crawlers, spiders, bots, macros, or scripts to perform actions on GOZFLY’s systems without consent.
• Attempting to bypass authentication or security controls.

6. Storage of Backups

Your hosting account may not be used as a backup system or general data repository. GOZFLY may remove such backups at any time, with or without notice. Backups must be stored externally or in a service designed for that purpose.

7. Zero Tolerance Spam Policy

GOZFLY enforces a strict anti-spam policy. The following activities are prohibited:

• Sending unsolicited bulk email (“spam”).
• Using purchased, rented, or harvested email lists.
• Forging or manipulating email headers.
• Hosting websites advertised via spam (“spamvertised”).
• Selling or distributing email contact lists.
• Operating mailing lists without verifiable opt-in consent.

Any account that causes GOZFLY IP addresses to be blacklisted may be immediately suspended or terminated, with or without notice.

8. Enforcement

GOZFLY may suspend or terminate your Services for any violation of this AUP, with or without prior notice. Enforcement actions may include:

• Disabling or removing prohibited content.
• Throttling or limiting server resources.
• Temporary or permanent suspension of your account.
• Reporting violations to law enforcement or regulators.
• Pursuing legal action if necessary.

Failure to respond to GOZFLY’s Abuse Department within forty-eight (48) hours, or within the time specified in our communication, may result in suspension or termination of your Services.

GOZFLY is not the publisher of customer-generated content and relies on competent courts and applicable legal processes to determine the legitimacy of defamation or similar claims.

9. Local Jurisdiction and Legal Obligations

Customers are responsible for ensuring their use of GOZFLY services complies with all laws applicable in their jurisdiction, including but not limited to:

• Anti-spam and electronic communications regulations.
• Privacy and data protection laws.
• Copyright and intellectual property laws.
• Content, obscenity, and decency regulations.
• Criminal, cybercrime, and consumer protection laws.

GOZFLY may take local legal considerations into account when enforcing this AUP and may respond accordingly at its sole discretion.

11. Acceptance

By using GOZFLY’s Services, you acknowledge that you have read, understood, and agree to be bound by this Acceptable Use Policy.
